Land in urban and peri-urban areas

A new State Environment Planning Policy (Vegetation in non-Rural Areas) has been developed that will apply to land that is not covered by the Local Land Services Amendment Act.

This includes areas such as the Sydney metropolitan area, urban zones across NSW, and all environmental conservation and management zones.

Some activities may impact a matter of environmental significance. In this instance, approval under the Environment Protection and Biodiversity Conservation Act 1999 may be required.

Routine agricultural activities that have been in operation since before 2000 will not trigger a need for referral.

Local Land Services is working closely with the Commonwealth to ensure a streamlined process for land owners by reducing the requirements for the dual consent and dual compliance.

The new arrangements will clearly identify the risks and triggers associated with the Environment Protection and Biodiversity Conservation Act, and only refer those matters that clearly require assessment.
